FUN FIX – Terms of Service

§ 1 Scope and Provider

(1) These General Terms and Conditions (hereafter: "GTC") apply to the use of the FUN FIX mobile app and related services provided by:

(2) Deviating conditions of users or partners are not recognized unless explicitly agreed upon in writing.

§ 2 Service Description

FUN FIX is a mobile platform designed for spontaneous, mostly same-day leisure activities and special events. Users participate by voting on suggestions or enrolling in specials, and are matched anonymously based on interests, availability, and other profile information.

§ 3 Definitions

• Suggestions: Activity ideas available for voting by users, matched based on user preferences and availability.
• Specials: Scheduled events requiring prior enrollment, matched independently.
• Matching: Automated, anonymous process using algorithmic, manual, or AI-driven methods to group users based on their preferences and profile details.

§ 4 Registration and Account

(1) Users initially register anonymously via Firebase authentication. Optional upgrades via email, Google, or Apple sign-in enhance account recovery.

(2) Users must select an avatar and username (nickname). Additional profile information (age, gender, languages) is optional but recommended to improve matching.

(3) Profiles can be deleted anytime via the app or website. Misuse or inappropriate behavior may lead to account suspension or termination.

§ 5 User Conduct

(1) Users must comply with applicable laws and respect the rights of others. Harassment, discrimination, illegal activities, spam, or misuse are strictly prohibited.

(2) Violations may result in immediate suspension, termination of the account, or other legal actions as necessary.

§ 6 Matching and Activities

(1) Matching is automatic, anonymous, and based on voting or enrollment. Matches are created if a minimum of three users share interests, aiming for groups of six. Users understand that matching results are not guaranteed and may occasionally contain inaccuracies due to the automated nature of the process.

(2) Matched users have access to a temporary group chat for limited periods (usually around 12 hours or longer for specials). Afterward, chats become inaccessible.

§ 7 Evaluation System

(1) After each completed match, users can rate the other participants. These ratings are strictly confidential and are not visible to third parties. They are used exclusively to improve future matching and to enable internal functions such as adding favorites, blocking, or reporting.

(2) The following rating options are available:

• "Would like to meet again" – adds the person to your favorites.
• "Neutral"
• "Prefer not to meet again"
• "Did not attend"
• "Report" – triggers a review by FUN FIX moderators.

(3) Aggregated rating data may influence future matching results. Repeated negative ratings or reports can lead to measures in accordance with § 5, including temporary or permanent suspension.

§ 8 Friends and Favorites

Users may add others as favorites and send "pings" (push notifications). Mutual favorites influence matching outcomes positively and enable better visibility of each other's activities.

§ 9 Location Suggestions

Users can suggest locations through Google Places API or platform recommendations. Daily limits apply to prevent spam. Paid subscribers may have increased limits in the future.

§ 10 Liability

(1) FUN FIX facilitates matching and communication only and assumes no responsibility for activity execution or events, nor liability for any damages or injuries during activities.

(2) Liability is limited to intent and gross negligence, except for injury to life, body, or health, or as covered by statutory liability.

§ 11 Rights to Content

Users grant FUN FIX a non-exclusive, worldwide, unlimited license to use all provided content for matching, promotional purposes, and internal operations.

§ 12 Changes to Terms

FUN FIX reserves the right to modify these terms at any time. Users will be notified about significant changes.

§ 13 Final Provisions

German law applies exclusively. The place of jurisdiction is Coburg, Germany.
